Arraingment Set for May 15

Superior Court Judge John J. Cheroske ordered that Byrd, Pedrosa, Reyes, Rea, and Sanchez be remanded into custody pending $150,000 bail to be posted by each man.  As of 4:16 p.m. PDT on April 13, all had posted bail except Pedroza and his status was unknown according to NBC news.

Changes

 I want to thank the readers of my blog which until now has been dedicated to the issue of Eminent Domain because of the proposed Lynwood Promenade/Power Center project.  The scope of Perspective on Lynwood as of today will change to include the news from the City Hall Council Chambers. 

As many of you know I frequently speak at Council Meetings on Agenda items.  Most of these items involve money;  Either the inept and inappropriate spending of our tax dollars or the increase in fines and fees.  From this point forward, I will post my comments directed to the Council.

Citizens and reporters know that currently there is a recall in progress to recall Council Members Leticia Vasquez, Alfreddie Johnson, Fernando Pedroza, and Louis Byrd.  Progress and updates on the recall will be posted here.

The reasons for the broadening perspective of this blog are:  

    1)  The unjust, deconstructionist approach to the City Code applied
         by the Council to achieve their personal agenda, not the good of 
         the community.

    2)  The lack of moral conviction of the Council Members that the 
         position of Council Member is that of Civil Service to the 
         community, not a position to lord over and disrespect the
         residents. 

    3)  The identified corruption by the Los Angeles County District
         Attorney's Public Integrity Division.

I will not stop blogging on the Lynwood Promenade/Power Center and eminent domain issues.  We must not let our guard down on the Promenade/Power Center.

Garden Grove Wants NFL Stadium

It seems as though Garden Grove would like Willowick Golf Course to be a NFL Stadium.  See the Los Angeles Times article.  (HT Lynwood Resident Doris.) 

It appears that Garden Grove is not the owner of the municipal golf course which has an address in Santa Ana!  According the the Los Angeles Times Garden Grove City Officials said they would be,"[I]neterested in allowing the NFL to build a stadium on the City-owned Willowick Golf Course."  

Actual planning and development would be Santa Ana's responsibility.  (The map in the times article is small so take a look at the Mapquest version for detail.)  The golf course is served by several major streets that lead to the 5, 22, and 57 freeways (aka the Crush). 

Nothing has been posted on either cities' website about Willowick.  However, after reviewing the Santa Ana River Vision Plan replacing the golf course that borders the Santa Ana River with a stadium does not fit into the vision.

Lynwood Unified Board of Education Passes Resolution

Tuesday, November 14, 2006 the Lynwood Unified School District Board of Education unanimously voted on Resolution 06-07/06.  All the residents who spoke at the meeting thanked the Board of Education members for taking this stance for the children in our community who would be displaced from their homes and schools by the Lynwood Promenade project.

I have been having trouble posting a scanned copy of the resolution to the blog.  I will post it as soon as the problem is solved.  At the meeting I requested from the Board that they post the resolution on the website.  So far it has not been posted.  I will have the link when it is available.

REGARDING THE PROPOSED POWER CENTER

Recently, many Citizens of Lynwood have expressed concern over a proposal received by the City about the “Power Center.”

A great deal of inaccurate and misleading information has been disseminated about this proposal and I am therefore writing to set the record straight.

First. no member of the City Council has approved this project. This is simply a proposal that has been offered to the Citizens of Lynwood for their consideration.

As your Mayor, I will never support any project that threatens the quality of education in Lynwood nor will I support the taking of schools from our families.

As your Mayor, I will not support a development project that will take homes from our hard working families.

As a graduate of Lynwood High School and teacher in Lynwood schools, I understand first hand the importance of public education, and as Mayor I have worked hard to improve educational opportunities for students in our community.

The City of Lynwood spends millions of dollars on education, including funds for City-run after-school programs, the Sheriff’s Explorer program, youth scholarships, funding for the Cesar Chavez Elementary School Parent Teacher Association, crossing guards, safe routes to schools program, youth employment programs, child care center funding, funding to local organizations that provide youth prevention and intervention services, and the renovation of the Lynwood Library. We have also fully supported the building of five new schools in Lynwood.

As your Mayor I am proud to say I was instrumental in making all this happen.

As your Mayor, I am committed to protecting our homes and schools. I will never support any project that threatens the quality of education in Lynwood nor will I support the taking of schools or homes from our families.

Rest assured that I will continue to work hard to create opportunities for continued social, economic and educational prosperity in our community. I will continue to lead our city in finding creative ways in which to make Lynwood a great place to live, work, and play and I welcome your active involvement throughout this process.

En gran parte la información respeto a esta propuesta ha sido interpretada incorrectamente. Es por eso que les envio esta carta para aclarar oficialmente su preocupación y inquietud. Ni yo, su alcaldesa ni ninguno de los miembros del concilio hemos aprovado este proyecto. Este ed simplmente una propuesta ofrcida a nuestr comunidad para nuestra consideracion.

Yo su alcaldesa, nunca apoyaría ningún proyecto que amenaze la calidad de educación en Lynwood o que quiten las escuealas de nuestras familias y nuestra comunidad. The Mayor and Coucil keep telling the citizens this is, "[J]ust a proposal."  However, it is a proposal that they have awarded an exclusive negotiating agreement to a single developer.  It's not a complete deal, but with Kelo v. New London and Prop. 90 failing, this is a REAL threat to our homes, schools, businesses, and churches.  It is not absolved by a e-newsletter from the Mayor.

School Board Meeting Tuesday November 14

 The Lynwood Unified School District Board of Education Meeting Tuesday, November 14, 2006 at 6:00 p.m.

The meeting is at the Lynwood Unified School District Offices on Bullis Road.  The Board will take a position on the Lynwood Promenade with NFL Stadium project.   This project, as proposed, will demolish three schools.  One school, is the new state-of-the-art Firebaugh High School which opened last year!

Come out and hear the Board of Education's stance.  Let the Board know you don't want to lose schools to the Lynwood Promenade project!

Fox News Gets It Wrong

 The citizens of Lynwood held a march from Firebaugh High School to City Hall protesting the proposed Lynwood Promenade and NFL Football Stadium.  I participated with about 200 of my neighbors.  The crowd at City Hall was estimated at 2,500.

Fox News was on the scene.  The first English speaking television media.  (Channels 34 and 22 have reported.)  The report made us out to be stupid and uninformed.  You can watch the clip.

Much to do about nothing, Ms. Devine?
What Fox News failed to say in the report is that developer John McDonald has presented plans to the City and has been granted an exclusive negotiating agreement.  Fox News also failed to report that the proposal has complete drawings from PGAL - Pierce Goodwin Alexander and Linville an architecture firm.  The copies of the drawings were passed out to the community attending a meeting held by the developer on November 1st.

Townhall Meeting

Monday Night October 30, 2006 was our packed out Townhall Meeting to disclose what was known about the proposed "Power Center" and NFL Stadium.  (My house would be taken for a parking lot!)  The panelists were trying their best to just present information and remain unbiased.  Considering that several are apt to lose homes or businesses and the emotional state of the residents in attendance, they did a good job.

Councilmen were allowed to speak.  They kept saying that this was only a proposal.  The center would bring jobs, more homes, more city revenues....  

Lynwood is one of the last communities where you can buy a house for under $500,000.  Many residents bought in before the Southern California boom, purchasing below $200,000.  They enjoy low property tax rates in houses that are well built and sit on large lots.  These residents love their homes and have worked hard to get them.  For many if their home is taken, they would not be able to buy again because of the higher mortgage and property taxes.

During the question and comment section of the evening, emotions understandably ran high.  The residents are angry and angry with four of their City Councilmen.  (City Councilwoman, Maria Santillan, must abstain from voting in this matter because she has a conflict of interest since she lives in the development zone.)  They feel they have been deceived by those in office that are to protect their interest.

As I was standing in line, James Andion walked by.  I stopped him and introduced myself.  He asked if he could speak before me.  He spoke in both English and Spanish telling the people he was their candidate for the 39th District.  He told them about Kelo and Yes on Proposition 90 would not allow their homes to be taken under eminent domain. 

I spoke and addressed questions to the panelists about Kelo v. New London.  They were unaware of the Supreme Court precedent.  I read the quote from Sandra Day O'Connor cited in a previous post. 

I raised questions on the incorporation of the developer.  The developer was not listed with the Secretary of State of California.  I located items in Nevada and Georgia.  The panel alluded to the incorporation being in Nevada.  I commented that being incorporated in Nevada easy and easier to hide behind the corporate veil of disclosing data, even to the Federal Government.

Justice O'Connor Prophetic in Kelo

In the dissenting opinion for Kelo v. New London, Justice Sandra Day O'Connor wrote:

Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random.  The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms.  As for the victims, the government now has license to transfer property from those with fewer resources to those with more.

Lynwood is a small city southeast of Los Angeles.  Of the 14,432 households, 7,006 or 48.54% of the households make under $35,000.  John McDonald and Imperial Partners, LLP, who want to take 1000 houses from low and middle income people for a football stadium, are truly taking advantage of those who have few resources.

Justice O'Connor was correct.

Sunday, October 29.....

He called!  The Republican candidate for the 39th Congressional District James Andion returned my call.  I brought him up to date on Lynwood's situation in light of Kelo.  He reminded me that California's Proposition 90 would stop this action.

Mr. Andion said he or a representative of his campaign would be at the meeting on Monday.

Now, I admit I had not read my Voter's Guide yet.  I had another project ending the 31st and planned reading after that.  I grabbed my copy to read Proposition 90. 

Yes Proposition 90 is our answer.  It is California's answer to Kelo.  It's not perfect, but it's good enough for now.  If the voters vote YES on 90 it would become effective Wednesday, November 8.

They Want to Build What??

Saturday October 28, 2006.  I should have known it was going to be a bad day.

After I put out my USC Trojan banner for game day, my neighbor Jose came over and asked me if I knew about a community meeting on Monday.  He told me that the City Council wanted to take our homes to build a NFL Football Stadium and shopping center.  I was in shockKelo v. New London had not only come to Lynwood, but had come to me. 

Jose did not know about Kelo.  I filled him in on the grim details of the Supreme Court decision that allows the government to take our private property and give it to a private developer.  I promised that I would do some research to see what we could do.

I got more details on the Kelo decision.  I found the Nancy Pelosi Press Conference when she was asked about Kelo.  After bumbling and demonstrating that she needs an 8th Grade Civics course covering separation of powers (and church and state) the questions and answers on Kelo continued:

Q Could you talk about this decision? What you think of it?

Ms. Pelosi. It is a decision of the Supreme Court. If Congress wants to change it, it will require legislation of a level of a constitutional amendment. So this is almost as if God has spoken. It's an elementary discussion now. They have made the decision.

Q Do you think it is appropriate for municipalities to be able to use eminent domain to take land for economic development?

Ms. Pelosi. The Supreme Court has decided, knowing the particulars of this case, that that was appropriate, and so I would support that.

The House Minority Leader agrees with Kelo and would not pursue legislation to protect the people she represents.  And to think that if the Democrats win the House, Ms. Pelosi will be Speaker.  Lynwood's Representative is Linda Sanchez who marches lock-step with the Democratic Party so she would be no help.


On the way to watch the USC game, I made some calls.

I called the Republican candidate hoping that there would be a response since the House Republicans are pursuing legislation to protect private property ownership.  I left a message.

I called the Jose Solache, Vice President of the Board of Education who organized the Town Hall Meeting.  I got names and other details to continue my research.  The proposed development would take about 1000 homes, numerous businesses, three schools and two or three churches.  The land boundary is from Imperial Hwy on the north, to the 105 Freeway on the south, from Wright Road (bordering the 710 Freeway) on the east to four streets west of Atlantic.

This was truly a bad day.

Kelo came to me, I could lose my home that my parents bought in 1967.

Rather than sulk, I'm getting active!
